Terms of Service

1. Introduction
Welcome to Create Tale ("we", "us", "our", or the "Service"). Create Tale is an AI-powered children's story generation service that creates personalized bedtime stories based on family profiles, daily highlights, and parent-provided information.
By creating an account, accessing, or using Create Tale (via our website or mobile application), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Create Tale. Please read them carefully. We recommend saving or printing a copy for your records.
2. Eligibility and Account Ownership
Create Tale accounts may only be created and managed by adults (persons aged 18 or older, or the age of majority in your jurisdiction). By registering, you represent and warrant that you are an adult, and that you are the parent or legal guardian of any children whose information you provide to the Service.
Children are not independent users of Create Tale. A child is a beneficiary of the Service through a family profile created and managed by the adult account holder. Children do not have separate accounts and are not a party to this agreement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access to your account.
3. Description of Service
Create Tale provides the following features, depending on your subscription plan:
- AI-generated personalized children's stories based on family member profiles, daily diary entries, and parent-provided context;
- Family member profile management (names, ages, interests);
- Daily highlight diary with optional photo uploads;
- Story series and collections;
- Audio narration of generated stories (Pro plan);
- AI-generated story illustrations (Pro plan);
- Optional public story sharing via the Story Library.
Features may vary between subscription plans. We reserve the right to modify, add, or remove features with reasonable notice.
4. AI-Generated Content
Stories, illustrations, and audio narrations are generated by artificial intelligence (AI) systems. AI-generated content may contain inaccuracies, unexpected phrasing, or content that may not be suitable for all audiences. Parents and guardians must review all AI-generated stories before sharing them with children.
We do not guarantee that AI-generated outputs will be free from errors, biases, or inappropriate content. While we implement content safety measures, no automated system is infallible.
We do not use children's personal data, photos, prompts, or stories for training or fine-tuning AI models. Data provided by users is processed solely for the purpose of delivering the requested service output.
5. Use License and Acceptable Use
Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial family storytelling purposes.
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to reverse-engineer, decompile, or extract source code from the Service;
- Use the Service to generate content that is harmful, abusive, hateful, or exploitative;
- Share your account credentials with third parties or allow others to use your account;
- Use automated tools, bots, or scripts to access the Service beyond normal use;
- Circumvent usage limits, access controls, or security measures;
- Resell, sublicense, or commercially redistribute Service outputs without our written permission.
6. Intellectual Property and Content Ownership
6.1. Service IP
The Create Tale name, logo, website design, application code, AI models and prompts, and all associated branding are owned by Create Tale and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our trademarks or brand assets.
6.2. Your Content
You retain ownership of the content you provide to the Service (family member profiles, diary entries, photos, and other inputs). By submitting content, you grant us a limited license to use it solely for the purpose of operating and delivering the Service to you — including story generation, display within your account, and backup/recovery operations.
6.3. Generated Stories
Stories generated by the Service are created for your personal family use. You may read, share within your family, print, and keep generated stories. The legal status of AI-generated works under copyright law varies by jurisdiction. We do not claim ownership of stories generated for your account, but we also cannot guarantee exclusive copyright protection for AI outputs.
6.4. Public Library
If you choose to publish a story to the public Story Library, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that story within the Library for as long as it remains published. You may unpublish a story at any time, and we will remove it from public display within a reasonable timeframe. You must not publish stories that contain identifying personal information about children (real names, addresses, school names, precise locations, or recognizable photos).
7. Subscriptions and Payments
7.1. Plans
Create Tale offers a free plan ("Dreamer") with limited features and a paid subscription plan ("Magician" / Pro) with expanded features. Current plan details and pricing are displayed on the subscription page prior to purchase.
7.2. Billing and Auto-Renewal
Paid subscriptions are billed on a recurring basis (monthly or annually, as selected by you). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. The renewal price will be the same as the current subscription price unless we notify you of a price change in advance.
7.3. Payment Processing
Payments on the web are processed by Stripe, Inc. Payments on iOS are processed through Apple In-App Purchases. We do not store your full credit card details. All payment processing is handled by the respective payment provider subject to their own terms and privacy policies.
7.4. Cancellation
You may cancel your subscription at any time through your account settings (web) or through the App Store (iOS). Upon cancellation, your subscription remains active until the end of the current billing period. After that, your account will revert to the free plan. You will retain access to your previously generated stories, but Pro-only features will become unavailable.
7.5. Right of Withdrawal (EU)
If you are a consumer in the European Union or European Economic Area, you have the right to withdraw from a digital content purchase within 14 days of the transaction, provided that the service has not been fully performed. By starting to use the Service immediately after subscribing, you acknowledge that you may lose the right of withdrawal once the digital service has been fully provided during the withdrawal period. We will clearly inform you of this before completing your purchase.
7.6. Refunds
Refund requests are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at the email address listed below. For iOS subscriptions, refunds are managed by Apple in accordance with their refund policy.
7.7. Taxes
Prices displayed may or may not include applicable taxes (such as VAT) depending on your jurisdiction. Any applicable taxes will be calculated and displayed before you confirm your purchase.
8. Children's Data and Parental Controls
Create Tale is a parent-directed service. Only the adult account holder may:
- Create, edit, or delete child profiles;
- Upload, manage, or delete photos;
- Publish or unpublish stories to the public library;
- Request data export or account deletion;
- Manage subscription and billing.
We do not knowingly collect personal information directly from children. All child-related data is provided by the parent or guardian through their account. For full details, see our Privacy Policy and Children's Privacy Notice.
9. Public Library and User-Generated Content
Create Tale may offer a public Story Library where users can share their stories with other users. When you publish a story:
- You confirm that you have the authority to share the story and that it does not contain identifying personal details about real children;
- You grant us the right to host, display, and moderate the content;
- You understand that published stories may be visible to other users of the Service;
- You may unpublish your story at any time.
We reserve the right to remove or moderate any published content that violates these Terms, contains inappropriate material, or exposes children's personal information.
10. Account Suspension and Termination
We may suspend or terminate your account if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or used the Service in a way that harms other users or our operations. Where possible, we will provide advance notice and an explanation.
You may delete your account at any time through your profile settings. Upon account deletion, your personal data will be processed in accordance with our Privacy Policy, including applicable retention requirements.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, complete, or appropriate for any specific purpose. AI outputs should always be reviewed by an adult before being shared with children.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Create Tale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (EUR 50), whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before the new Terms take effect.
14. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Create Tale is established. If you are a consumer in the European Union, you also retain the protection of the mandatory consumer protection provisions of your country of residence.
Any dispute arising from or relating to these Terms shall be resolved first through good-faith negotiation. If the dispute cannot be resolved amicably, it shall be submitted to the competent courts in the jurisdiction of our registered office, subject to any mandatory consumer jurisdiction rules that may apply.
If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. Language
These Terms are published in English and may be translated into other languages for convenience. In case of any conflict between the English version and a translated version, the English version shall prevail.
